How deposit return actually works
Every state sets a deadline for a landlord to either return the deposit or send an itemized list of deductions after you move out. The window commonly runs from 14 to 45 days, with 30 days being the most typical.
Miss that deadline and most states impose a penalty. Depending on where you rented, that can be forfeiture of the right to withhold anything, or damages of two to three times the wrongfully withheld amount, sometimes plus your court costs.
Normal wear and tear is not deductible anywhere. Faded paint, minor carpet wear, and small nail holes are the landlord's cost of doing business; a broken door or a stained carpet caused by you is not.
Before you send the letter
- Confirm your move-out date and the exact day the deposit deadline expired
- Gather move-in and move-out photos, the lease, and your forwarding-address notice
- Add up the deposit paid and subtract only deductions you agree are legitimate
- Check whether your state allows a multiplier penalty — it changes the amount you demand
- Have the landlord's correct legal name and service address, not just the property manager's email
What happens after you send it
Most landlords pay at this stage. A dated letter that names the statute, the deadline they missed, and the multiplier penalty they're exposed to is a much cheaper outcome for them than a court date.
If the deadline in your letter passes, the next step is small claims court, where deposit disputes are among the most common cases and where you don't need a lawyer. Filing fees are usually modest and your letter goes in as an exhibit showing you tried to resolve it first.
